 2nd Circuit Court decision
Author: Mark Charette
Date:   2015-05-11 22:36

PANDORA MEDIA, INC., Petitioner–Appellee, v. AMERICAN SOCIETY OF COMPOSERS, AUTHORS AND PUBLISHERS - See more at: http://caselaw.findlaw.com/us-2nd-circuit/1699863.html?DCMP=NWL-pro_ip

Affirmed and upheld lower court in an important decision:

ASCAP licensing is take it or leave it - some publishers wanted ASCAP to treat some customers (new media" like Pandora) differently and not grant a license to broadcast. If a publisher wants such a licensing mode, they must withdraw from ASCAP and are free to do so.

The other affirmation of a lower court decision has to do with what are reasonable rates.
