 Rudolph's Clarinet and Piano Sonata
Author: Wayne
Date:   2002-03-16 01:46

Greetings: Does anyone have the Sonata for Clarinet and Piano by Archduke Rudolph that I can borrow ? I'll happily cover all costs involved ! The score is currently out of print. I've contacted all the major sheetmusic suppliers (and then some),

Thanks !

Did you try contacting Musica Rara directly?

GBK: Several stores, including Luyben, Frank Music & Patelson in NY as well as Sheet Music Service in Portland, Or report that MR has been absorbed twice in the past year by larger publishing houses. I contacted Theodore Presser Inc. who sounded like their latest owner and was told it is currently out of print. I'm appreciative of any help/advice I can get (or borrow!). The catalog number is MR 1647 wherever I've found it listed.
Just finished the Schuman Fantasies and would love to start on this while my pianist (and MUCH better player!) is up for another piece.

Thanks, WB

Wayne...I think the latest is that Musica Rara's catalogue was acquired by Breitkopf & Härtel.

I just rechecked Breitkopf's site. Unfortunately they list it as out of print.

Perhaps Breitkopf will give you permission to make a copy. Associated Music gave me permission (in writing) to copy a piece of out-of-print music for a student once (ironically, I have since lost the original!). If you get permission from Breitkopf, perhaps I can help.

The form is at http://www.mpa.org/copyright/op.html

However:

I am not a lawyer and cannot dispense legal advice, and I am a very strong proponent of copyright laws (perhaps not in their current form, but in principle anyway). However, this music is completely out of copyright in the US since the Archduke died in 1831. If someone made a copy of the music and covered any written editorial notations (words, not music) it would be well within the public domain as long as the music you are copying is copyrighted in the US. Layout alone is not copyrightable in the US ("sweat of the brow" protection under copyright law was explicitly set aside in the US Supreme Court's "Feist" decision). Other countries may have different laws.

Copyright generally is a difficult subject to discuss since there are so many myths abounding. For the US see http://www.templetons.com/brad/copymyths.html and http://www.sneezy.org/clarinet/Misc/46DLJ241.html.

A excelent recording for the clarinet works by Archduke Rudolph of Austria, is the CD of Ricardo Morales (Met prnicipal). In this recording, Mr. Morales play the Archiduke's Trio (for clarinet, cello and piano).

I'll play the trio in may.
