Yes, please ask permission before you use a photo from eBay. I've had mine "ripped off" before and used to advertise someone else's eBay auction. It was an obvious rip off because the serial no. of my clarinet along with registration papers were clearly shown in my photo. The bad thing was, the guy who stole my photo didn't ask permission to use it and he wasn't selling a new clarinet and I was. Then, he set a much lower price and listed it on the final day of my auction and really hurt the final price of my clarinet because people emailed me saying they had found a used one that looked as nice as mine. It WAS mine! I complained to the seller and he said, "Well, I needed a photo of a clarinet like mine." He didn't apologize and just kept running his misleading photo. I reported him to eBay officials and they shut down the guy's auction.
So, be careful when you "borrow" a photo off eBay. If you're going to use it for private reasons and not for selling your clarinet, you might find a seller eager to help you out. Otherwise, take your own photo and scan it to .jpg for the web.

in all actuallity, I would say that that person had violated copyright rules..
that photo, being yours, taken by you, belongs to you unless you give permission,
or sell the photo for use.....
I am not a copyright attorney, but, you took it, you are the artist of the photo, and the item being shot, all belong to you, so you have exclusive rights to it.
I do not know who runs the ebay bit, or if there is any recourse that you have,
but depending on how much you lost or might have lost might be worth while
in trying to recoup....

Being a retired professional photographer I can tell you that you DID own the photograph you sent in and if you wanted to persue it any further you would stand a very good chance in court. Collecting, however, might be a different story. I would definitely consult with an attourrney before I went any further and get the facts from them. You did right by reporting it to ebay!!
