 Talent show audition
Author: runner

As a part-time Wal*Mart associate, I have the opportunity to submit a two-minute "talent" video. Thirty semi-finalists will be chosen to be voted upon by Wal*Mart workers nation-wide.
My problem is I just read the rules. It stated that copyrighted music is not allowed. I did submit a portion of Rondo Alla Turca by Mozart (piano). I presume that is not copyrighted. But even if it is I could resubmit using two pianos to show originality or creativity.
As a clarinetist, what could I possibly do to get chosen for the top thirty? Any ideas? I also play sax and flue/piccolo.

Bob:

Can you inquire with management/the contest organizers on what their intent was to exclude copyrighted materials?

Was it that they expect original works only--which doesn't seem likely--or that they want to make sure that you...i.e. they don't infringe upon the copyrights of those legal entities that hold the copyrights, and deny them their due compensation under the law.

Case in point--in all the auditions I've had---and there've been many, photocopies of materials were not allowed....the presumption being that photocopies allow the abuse of a single copyright license, and deny the copyright holders the right to the additional revenues that would have occured had the photocopy holders instead gone out and purchased a single use license of their own.

This may be as easily solved as submitting with your addition, an authentic non-photocopied version of the musical work, as purchased legitimately from a copyright holder. I can't imagine Walmart legal, or any institutions legal department should have issue with that unless this is an original works only competition.

Best of luck!

My bet is that they expect to have the right to use the videos, or later performances, however they like- without the need to pay any 3rd parties.

If you learn this is an overly harsh assessment, let us know and I'll apologize.

I'm nearly certain this is the reason they would require PD material, but I don't think there's anything harsh in the judgment. Assuming they plan to use the winning submissions in some sort of promotion, they really have no choice unless they're willing to research, track down and pay rights holders for every submission they decide to use. If you submitted a performance of Viktor's Tale - a fun clarinet piece written by John Williams for the movie "The Terminal" - a performance license would need to be negotiated for any public use made of the video.

I often wonder when companies run national TV ad campaigns using clips of protected material or arrangements and take-offs obviously based on a protected original (eg. the Fiber One commercial using the tune of Total Eclipse of the Heart, or the car commercial that used "It's now Or Never"), what fee arrangements are customarily made for permission to use the material. I would think the money involved must be astronomical.
