Youtube really sets themselves up for litigation for allowing (not seeing) that stuff.

I think you are confused. The videotaping itself was obviously taken with permission, and in any event, no video hosting site "sees" any video as the video is being shot. YouTube has, at its own great expense, developed a ContentID technology that allows copyright owners to provide a reference file to YouTube that YouTube can then match as third parties attempt to upload video to the site. This is a very practical and widely used technology that prevents allegedly infringing videos from ever being hosted.. You should also be aware that as of January, it has been estimated that one hour of video is uploaded to YouTube every second of every day; prescreening that much video would be quite a task. But for those who don't want to or can't provide a reference file, the Digital Millennium Copyright Act provide a notice and take down procedure.

By the way, when I joined Google in October 2006, the first deal I worked on was the YouTube acquisition.

There are so many different permissions that the screen capturer didn't get.

Ya can't just tape something off of TV, and upload it to YouTube.

Yet it happens constantly.

The "procedures" are a complete joke.

You, nor I, can't complain to Youtube about an infringement, unless it is directly ours. So unless NYPO, or the TV Station complain, nothing will be done about it.

Someone had the audacity to download from itunes, and then upload the John Williams Clarinet Concerto to YouTube, and actually argued that he "had the right" to do it.

Uh, NO - and I got it removed.

It's absurd that they won't review a track or video without someone directly involved as a copyright holder making the claim.

David, respectfully, I totally disagree with your views. I note that in the case you cite, the video was removed. If you would like to be educated, follow this link, which shows great detail about the number and types of take down requests received for search (YouTube and Blogger are separate):

It makes perfect sense that only copyright owners (or their representatives) can make a claim because that is the way the statute is drafted. Your complaint should be made to Congress if you want the ordinary rules of civil law reversed.

It is a great library, however - that video has ads on it.

So, the guy who sat in front of his TV to record, and distribute (hence the illegal part), is also getting paid for its views.

The website linked in a follow up IS the legit way to view the performance.

This is the last I will say on the subject too: you shouldn't assume that any ads that are run on any videos containing music are to the benefit of the uploader. They may be to the benefit of the copyright owner of the musical composition, which in this case would be Respighi's heirs, his publisher, or both jointly. As an aside, my composition teacher when I was a young music student had been a student of Respighi.
