 Copyright Follies

Metallica has a signature chord "progression" -- alternating between E and F. They've now sued someone for using it.

Am I liable if I practice the Baermann III page in E and then go to the one in F?

What's next? Philip Glass suing some for NOT changing harmony?

Of course, if you don't play, you're violating a copyright ...

Maybe the Canadian band could just say they are using a D double sharp to G double flat. I know this is bad theory, but hey, this lawsuit is ridiculous. I am sure that with a little research, someone could say they associate E-F with say, Bach or maybe Mozart. GEEZ!!

"Metallica has a signature chord "progression" -- alternating between E and F. They've now sued someone for using it"

One of the better parodies from the people at http://www.scoopthis.com/

What is amazing is how many people will fall for it.

By the way, Metallica would have had no case - because everyone knows that since 1975 the rights to the E/F progression are owned by John Williams ( "Jaws" ) ...GBK

I did a quickie US patent search on "metallica", found 3 pats of interest, [relating to recording??] , but only by their mention of Metallica's "Fade to Black" "session". Terminology is beyond me, and of course copyright law [infringement?] [US and Can] is widely different from patent law. Don

Thanx, Mark, Don

Thats OK, Diz, I really didn't know either. An AOL-Google search turned up quite a bit of stuff!, pointing us to a "Hard Rock" Group of US ? "musicians???" . I have many reservations re: quality. Hang on, this is a "funny roller-coaster", I'll bet. Don

The E7 to F7 chord progression pre-dates Metallica. Jailhouse Rock begins with repeated E7 to F7 chords. Perhaps Leiber and Stoller should sue Metallica.

I apologise for intimating in any way about attributing the use of the dominant 7th in any way, or associating the dominant 7th in any way with Metallica. Just in case thhe ambulance chasers are reading this. I always though that metal band guitarists tuned there instruments lower than the standard E tuning. I would beware of used Eb to E this may be the real issue.

Hey - you mean NONE of you have every listened to Metallica and enjoyed it?!!! Or are you scared to admit it? ;-) they are THE heavy metal band of history -come on!!!! give 'em some respect....at least try anyway. The are a tight ensemble - especially rhythmically. And how can you not be a little creeped out after hearing "Enter Sandman" (granted, these days I can listen to about 45 seconds of them before I turn the dial.) Plus, any musician who is willing to travel the way those guys are to make money gets some respect from me.

Hey, some of us think that AC-DC should have this title.

Signed,
