I bought a Buffet oboe on Ebay from a dealer in Florida who represented it as new (although not in writing). The horn quickly developed two cracks, despite my following a careful "break-in" regimen.
I contacted the dealer and sent it to Boosey & Hawks. While they agreed to repair the cracks, they said that they wouldn't replace the top joint since the warranty did not apply to Ebay purchases.
To their credit, Boosey was very understanding about the whole thing; they obviously care about their reputation.
Caveat emptor.

You expected a warranty from an auction??? That's an unreasonable expectation. Ebay is not a store or dealer or anything else. It is an AUCTION. Auctions are always caveat emptor.
Occasionally a seller will agree to take it back or, in the case of some dealers, warranty it themselves. But if it is not in writing, there's no warranty.

This seems similar to the problems encountered with "gray market" merchandise, that is new goods sold by those other than dealers authorized by the manufacturer to sell in the country of the sale. Usually the warranties do not apply, and in the case of electronic gear, the product may not even work properly due to voltage or other differences.
When making such purchases it is essential to be very sure that what you are getting will work, and that the price is low enough to be worth a gamble on not having a warranty.

Unless the seller is a Buffet dealer and you actually get the warranty card and send it in within 10 days of the sale, you won't have a guaranteed warranty. But, the card absolutely has to be sent in within 10 days from the sale and you have to purchase it from a legit Buffet dealer.
