How can someone "edit" a scan of the manuscript? Any claim would be
void, and the scan can be freely copied as long as any introductory
material or scholarly apparatus are omitted.

The only exception would be if the MS had never been made available,
which would put it in the same box as the Winterthur Fragment of the
Mozart Concerto, but by publishing the MS, it automatically becomes
"available" and loses the unpublished=material common-law copyright,
at least in my view. Also publication of parts of the MS in The
Clarinet would make those parts freely available.
