The U.S. Supreme Court recently agreed to hear a challenge to the 1994 legi=
slation that restored copyright to foreign works that had fallen into the p=
ublic domain in the U.S. for failure to put on the required copyright notic=
e or for failure to file a renewal application 28 years from first publicat=
ion. The restored copyrights covered works first published from 1923 to Dec=
ember 31, 1977.
I believe the Prokofiev flute sonata was premiered in 1943 but don't know w=
hen it was published. We didn't have copyright relations with Russia then, =
so all Russian works were in the public domain in the U.S. =A0at the time. =
This is why, when Stravinsky moved to the U,S., he revised his early ballet=
s in order to get a derivative work copyright on them. Russian works that w=
ere in the public domain due to a lack of copyright relations were also pul=
led out of the public domain by the 1994 legislation.
If the law is held unconstitutional (and I worked on drafting it when I wor=
ked for Congress), then these works will be back in the public domain.

After Masters Music bought Ludwig (at least I think that is what
happened), someone decided that this edition could no longer be
published because the copyright had been restored to the original. You
would have thought they would have tried to get permission but
apparently not.
