When I was in college I read Louis Nizer's "My Life in Court." That was my first awareness of the problem of copyright infringement when Nizer described his victory in the case involving "Rum and Coca-Cola."

It's over a half-century since I read the book, but I seem to recall that Morey Amsterdam's defense was partly based on his claim that the music was from a traditional folk song so was not copyrightable. The Wikipedia description claims that not only was it composed by someone alive and kicking but that most of the composer's lyrics were lifted from the original for the hit song.
