M D'Aura asked what I thought was a fairly reasonable question:
<<<Joyce, I just had to ask about a quote from you Boutique website....
"Your source for quality designer replica handbags, apparel, gifts,
accessories, and more!"
The word REPLICA is flashing in my mind. I could be wrong, but I've always
thought it was illegal to sell REPLICA handbags. Am I incorrect about
this?>>>
Joyce Jackson from Anitatu's Boutique posted in response:
<<<No it is not illegal, hence the disclaimer. You know, I apologized to
your group so why you all insist on making further issues is beyond me.>>>
I'll start with the clarinet-relevant part. To quote the Gershwins, "it
ain't necessarily so."
It's difficult to tell since the thumbnail pix are so small, but the "Louis
Vuitton" bags all appear to carry the well-known "LV" logo. That's a
trademark, and a valuable one indeed. The fact that the bags aren't
advertised as authentic doesn't mean that there isn't a violation of the
Lanham Act if the trademarked logo is applied without the applicable
license.
If the logos are easily distinguishable, however, the trade could very well
be legal. Poor taste, true, but legal nonetheless.
