I realize that a person's motive for violating a copyright is irrelevant
in the eyes of the law. That is, I cannot violate a copyright without
penalty simply by saying "Hey, I didn't make any money from this, so I
haven't done anything wrong."
....nevertheless, Google is hoping to rake in $$$ by using the off-line
work and skills of authors without the authors' permission. There does
seem to be a certain amount of injustice in this, even if it doesn't
violate current law.
It would be a different situation, of course, if Google had approached
(say) Dan Leeson and had obtained his permission to use a large portion
of his book for their own profit. I assume this is not the case,
however.
I included the word "off-line" because, in some situations at least,
providers of online services can make forfeiture of certain rights a
contract condition in order to receive service online. So perhaps an
Internet service agreement could include 'fine print' which relinquishes
some part of a copyright in exchange for doing business from a web site?
I presume, for example, that owners of web pages are allowed to store
cookies on my machine because I have (somehow, somewhere) given
permission?
