And you don't have to distribute all that many...
Mostly you have to show clear intent to participate in the act of
publishing, even if none are actually purchased. (Though the latter
helps.) Of course, you're responbsible for all concerns of copyright
laws and the "oops" that can come with that in the environment around PD.
Personally, I stay away from publishing new editions of PD works,
though I do publish arrangements and compositions which include
PD-derived material.
