Companies are legally required to remove you from their telemarketing
lists when you make the request during a phone call from one of their
representatives. There's no point in playing games and hoping to out-
smart them. People have gotten wise and begun recording phone calls
when telemarketers call, being sure to have the rep repeat their com-
pany information, and then recording themselves asking the rep to re-
move their name and number from the company's list. Law suits have
been won on this basis. Similar suits have been won with respect to
junk mail, where the consumer had a rubber stamp made with an affida-
vit on it, stamping it on the back of their personal check when using
a check to buy merchandise. The company endorses the check in order
to cash it, and their endorsement on the back of the check also testi-
fies that they agree to the terms of the affidavit which the consum-
er has put there. Consumers who have done this and then received junk
mail subsequent to the cashing of their checks have successfully secur-
ed damages in court for breach of contract.
