You answered your own question. The laws vary, so "Jim" could very well be
the completely legal owner of the property. Let the insurance company do
what it must and get their end settled before jumping to any legal
conclusions. For all we know the insurance company might have been notified
by the PD and they decided it wasn't worth being recovered by them.
