I agree with whoever posted that the _insurance company_ is the
organization with the resources, knowledge, and second-best motive (and
ultimately the respect of the court system) to take action in this case
if any is appropriate.
Also they are the organization most likely to achieve a result that
David Hatner wants -- as opposed to getting David into unexpected
dilemmas or liabilities or counter-claims.

By the way, the legal advice that I received from legal newsgroups
and web sites was either not helpful or downright inappropriate. One
more reason to pass the matter on to an insurance company who knows the
ropes (as David apparently has done already).

I will, however, repeat my own warning that David may not want the
instrument back now. Who's to say what condition it's in now?
