3 months _prior_ to the instigation of the suit. Damages occuring before the 3 month peiod would not be recoverable (at least in the decisions of the Circuit Courts so far, but that may change soon due to the inequities between US and non-US citizens for the registration requirements).

I think we may be straying too far afield of the list topics ...

In any case a visit to a lawyer, solicitor (or more probably a barrister), advocate, or other legal representative is in order before you either copy materials without permission or sue.
