Regarding the review of a music festival by Annette Morreau, Tony Pay wrote,

There's another possibility. I assume that the "c" in front of Morreau's
name is ASCII for the copyright symbol and I notice that it's in her own
name, not "c The Independent". Some periodicals buy all rights or arrange
for staff writers to do work-for-hire. A periodical that owns all rights can
republish an article at will (on a website, for instance, or in an
anthology), without asking the author's permission. Most periodicals buy
limited rights, specified in a contract. Most periodicals I've dealt with
buy only first serial rights, for one-time editorial use. If The Independent
buys only first serial rights, then the copyright would remain in the
author's name (as apparently it has done) and the journal would need her
permission to republish the article on the web site. Maybe she refused
permission.
Maybe she had good reasons to prevent further circulation of this article.
(I've refused republication of some of my own work because I wrote it in
haste and was unsatisfied with the quality; or I later learned of factual
inaccuracies in the article; or the editor made additions or deletions that
caused the article to misrepresent my opinion. For well-known, agented
writers, often it's simply a question of money, although in my case, the
amounts of money involved are too small to be worth bickering about!) I see
no indication that Morreau gave permission for the article to appear on the
klarinet list, either, or to circulate generally -- one reason why I queried
to clarify what this message was and where it came from, before I started
ranting.... ("Oh, no, there goes Lelia, haranguing about #$%^&! copyright
again....") I'm still not clear about whether this is Morreau's entire
article or an excerpt (if it's an excerpt, it's too long to be kosher,
especially given that it's unaccompanied by any criticism), but, with no
information to the contrary, I have the impression that the article appeared
on this list without the author's permission. Therefore, I've decided not to
comment on the substance.
