The most performed song of the 20th century is HAPPY BIRTHDAY TO YOU,
according to ASCAP, THE PERFORMING RIGHTS SOCIETY.

A Kentucky school teacher, Mildred Hill, wrote the melody Happy
Birthday. A younger sister, Patty, wrote the lyrics. It was first
published in 1893 as Good Morning to All.

In 1924 Robert Coleman put the melody in a songbook and changed the
second stanza to Happy Birthday to You.
The Hill family sued for copyright, which they got.
Only the tune is covered not the melody.
Thus if the song is sung privately, its OK, but when in public you are
required by US law to pay a royalty to Warner Bros.

ASCAP says that waiters singing this in a restaurant are performing it
publicly and are required to pay a fee.
The song will be in Public Domain in 2010.

One chain, the Red Lobster, have their own words for this song:

A birthday wish from us to you
We hope you get your birthday wish
and come back soon to eat more fish.
