I would think that the lease your roomy signed would supercede New York =
Law. Sorry, but I'm not a lawyer.

Subject: [kl] apartment dweller woes
Greetings klarinetters!
I am writing for advice on a rather urgent issue. I am a music =
student=20
living in New York City, and I find it neccessary to practice in my=20
apartment from time to time. I practice in the practice facilities =
provided=20
by my school whenever it is possible, but occasionally it is not. =20
Unfortunately, our lease states that practicing of musical instruments =
is=20
not allowed. (The lease was signed by my roomate before I was informed =
of=20
that clause!)
Until now I had just gone ahead and practiced in the apartment anyway, =
between reasonable hours. (I have practiced there probably less than =
20=20
hours total since September.) Unfortunately the woman who lives below =
us=20
complained to my roomate today and told her that she will report it to =
the=20
superintendant if she hears me again.
I have heard from several people that there is a New York City =
tenant law=20
that states that it is legal to practice in an apartment from 10am to =
10pm=20
no matter what the lease says. Does anyone have any information on =
this, or=20
know where I might find information to back me up? I'm not sure if =
the law=20
(if it exists) applied only to residents of Manhattan, or all 5 =
boroughs,=20
since I live in Queens. I have trouble believing that my practicing =
is=20
THAT disruptive to anyone's life, but.....
Does anyone have any experience in this type or situation? Any=20
information, opinions or advice is greatly appreciated!!
Sincerely,
C. Crispin
