In the USA:

Music out of copyright can be freely downloaded and disseminated.

Music that is copyrighted can be downloaded with permission of the
copyright holder - which might include a payment. The copyright holder
is free to disallow all downloads, too.

Nothing different or special about MIDI; it's a representation of the
music, and regular copyright laws apply.
